A temporary restraining order (TRO) has been granted in the Texas Hemp Business Council lawsuit against the Texas Department of State Health Services.👉 Official TRO Announcement What this means:
The court has temporarily blocked enforcement of several key provisions challenged in the lawsuit, including: Redefining hemp: A more restrictive interpretation of “total Delta-9 THC” which includes THCA in the calculation. Blocking interstate supply: Limitations on hemp material entering Texas for processing and manufacturing Excessive penalties: Disproportionate enforcement penalties for businesses Important note:
The TRO does not apply to licensing fees, which remain in effect at this time. This is an important step forward, but it is temporary, and the case will continue to move through the legal process. The TRO will be in effect until the injunction hearing on 4/23/26. We will keep you updated as more information becomes available.
